1. Agreement to Terms

These Terms of Service and End User License Agreement ("Terms" or "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Promise Technologies Pvt. Ltd. ("Promise," "we," "us," or "our").

By downloading, installing, accessing, or using the Promise mobile application, web verification portal, or related software services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

2. Scope of License (Apple & Android Standards)

Promise grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the mobile application on compatible devices that you own or control, strictly in accordance with these Terms and the applicable usage rules of the Apple Media Services Terms and Conditions or the Google Play Terms of Service.

You agree not to reverse engineer, decompile, disassemble, rent, lease, loan, sell, distribute, or create derivative works based upon the Service or any part thereof.

3. Acknowledgments for App Store Platforms

If you downloaded Promise from the Apple App Store or Google Play Store, you acknowledge and agree that:

• This Agreement is concluded between you and Promise Technologies Pvt. Ltd. only, and not with Apple Inc. or Google LLC. Promise is solely responsible for the Service and the content thereof.
• Maintenance & Support: Promise is solely responsible for providing maintenance and support services. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the app.
• Warranty: To the maximum extent permitted by applicable law, Apple and Google will have no warranty obligation whatsoever with respect to the app. Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Promise.
• Product Claims: Promise, not Apple or Google, is responsible for addressing any claims relating to the app or your possession and use thereof, including product liability claims, consumer protection claims, and regulatory compliance.
• Intellectual Property Claims: In the event of any third-party claim that the app or your possession and use of the app infringes a third party's intellectual property rights, Promise, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Third-Party Beneficiaries: Apple, and Apple's subsidiaries, and Google are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

4. Mental Wellbeing & Medical Disclaimer

If you are experiencing severe mental distress, acute anxiety, depression, or suicidal thoughts, please stop using the app immediately and contact your local emergency medical service or a national mental health crisis hotline (e.g., in the US call 988; in India call 14416 or 9152987821; in the UK call 111).

5. Digital Purchases & Subscriptions

Core promise creation, daily habit tracking, and ally pacts are free. We offer optional digital additions:

• Artisan and Masterwork Cosmetic Seals: One-time digital purchases ($0.99 and $1.99) granting permanent access to specific handcrafted SVG visual styles on your active devices.
• Promise Pro All-Access Pass: An optional subscription ($1.99 per month or $19.99 per year) unlocking all present and future themes, acoustic soundscapes, and encrypted cloud backups.

Auto-Renewal Terms: Subscription payments are charged to your Google Play or Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle. You may manage or cancel subscriptions anytime in your device Account Settings.

6. User Content & Intellectual Property Sovereignty

Your Content: You retain 100% full legal ownership of all commitments, personal vows, diary reflections, and audio recordings you create within Promise. By recording commitments, you do not grant us any marketing or commercial rights over your private thoughts.

Our Property: All software source code, algorithmic valuation formulas, vector crest designs, UI layouts, audio soundscape compositions, and trademarks are the exclusive intellectual property of Promise Technologies Pvt. Ltd.

7. Acceptable Conduct & Handle Revocation

You agree not to use Promise to:

• Record illegal covenants, contractual fraud, threats of violence, or hate speech.
• Harass, stalk, or send unsolicited mutual pact requests to third parties.
• Register username handles (@handle) with the intent of trademark extortion, impersonation of public officials, or domain squatting. We reserve the absolute right to reclaim, suspend, or reassign offending handles without liability.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Promise Technologies Pvt. Ltd., its directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, reputation, or personal productivity, arising from your access to or inability to use the Service.

In no event shall our total aggregate liability exceed the greater of the amounts paid by you to Promise in the twelve (12) months preceding the claim, or one hundred US dollars ($100.00 USD).

9. Dispute Resolution, Binding Arbitration & Class Action Waiver

Informal Resolution: You and Promise agree to first attempt to resolve any dispute, claim, or controversy informally by sending a written notice to legal@sovereign-promise.app. Both parties will negotiate in good faith for at least 30 days before initiating formal arbitration.

Binding Individual Arbitration: If the dispute is not resolved within 30 days, it shall be settled by binding individual arbitration under the rules of the Indian Arbitration and Conciliation Act, 1996 (or for US residents, the American Arbitration Association under its Consumer Arbitration Rules). The seat of arbitration shall be Bengaluru, India (or the nearest metropolitan center for international consumers). The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Class Action Waiver: YOU AND PROMISE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to the arbitration clause above, you agree to submit to the exclusive personal jurisdiction of the courts located in Bengaluru, Karnataka, India.
